Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from voxlumiere.com (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site. [Facebook Pixels, Instagram Pixels, Google Analytics]

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, PayPal), email address, and phone number.  We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

  • Communicate with you;

  • Screen our orders for potential risk or fraud; and

  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We may also collect personal information that you voluntarily provide to us when you sign up for updates, enter a competition or prize draw, complete a lead or enquiry form, respond to an advertisement, register for an event, purchase tickets or merchandise, or otherwise interact with us. This information may include your name, email address, mobile telephone number, location, marketing preferences, and other information you choose to provide. We refer to this as “Contact and Marketing Information.”

We may collect Contact and Marketing Information directly through the Site or through third-party platforms and services that we use to communicate with our audiences, including social media advertising and lead-generation platforms.

Providing a mobile telephone number does not, by itself, constitute consent to receive marketing text messages. Where consent is required, we will ask separately for your permission to contact you by SMS or other mobile messaging.

When we talk about “Personal Information” in this Privacy Policy, we mean Device Information, Order Information, and Contact and Marketing Information.

We may also use Personal Information to:

  • respond to enquiries and requests;

  • administer competitions, prize draws, promotions, and event registrations;

  • provide important information relating to purchases, tickets, competitions, events, or other interactions with us;

  • manage our customer and audience relationships;

  • maintain records of marketing preferences, permissions, withdrawals of consent, and opt-outs; and

  • where permitted by applicable law and in accordance with the preferences and permissions you have provided, send you marketing communications about Vox Lumiere performances, tickets, special offers, merchandise, music releases, competitions, events, and related products and services.

Where applicable data protection law requires us to have a lawful basis for processing your Personal Information, that basis may include performance of a contract with you, compliance with a legal obligation, our legitimate interests, or your consent, depending upon the particular purpose for which the information is being used.

Where consent is required for electronic direct marketing, including marketing by SMS, we will rely on your consent.

MARKETING COMMUNICATIONS AND SMS

Where you separately choose to receive marketing communications from us, we may contact you using the communication methods for which you have given permission.

If you opt in to receive SMS or mobile marketing messages from us, we may send you messages concerning Vox Lumiere performances, ticket availability, special offers, competitions, merchandise, music releases, events, and related news.

Consent to receive SMS marketing is voluntary and is not a condition of making a purchase, entering a competition or prize draw, or otherwise using our services.

We will not treat the fact that you provided a telephone number in connection with a purchase, competition, enquiry, lead form, or other interaction as consent to receive SMS marketing unless you separately indicated that you wished to receive such messages.

You may withdraw your consent to marketing communications at any time. For SMS messages, you may use the opt-out method identified in the message, such as replying STOP where that facility is available. You may also contact us at hello (at) voxlumiere.com.

Withdrawing consent will not affect the lawfulness of any processing that took place before your consent was withdrawn.

We maintain records of marketing permissions and preferences so that we can respect your choices. If you opt out of marketing, we may retain limited information, such as your telephone number or email address, on a suppression or “do not contact” list to ensure that we do not inadvertently contact you again for that purpose.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above.  We use Google Analytics to help us understand how our customers use the Site–you can read more about how Google uses your Personal Information here:  https://www.google.com/intl/en/policies/privacy/.  You can also opt-out of Google Analytics here:  https://tools.google.com/dlpage/gaoptout.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

We may share Personal Information with service providers that process information on our behalf and assist us in operating our business. These may include website and hosting providers, payment processors, ticketing providers, customer relationship management services, email and SMS messaging providers, analytics providers, advertising platforms, and other technology and professional service providers.

Where we use an SMS or mobile messaging provider, that provider may process your mobile telephone number, message information, delivery information, and related technical data as necessary to provide the messaging service on our behalf.

We do not provide your mobile telephone number to third parties for their own marketing purposes unless you have separately consented to such use.

We require service providers processing Personal Information on our behalf to handle that information in accordance with applicable data protection requirements and our instructions.

YOUR RIGHTS

If you are located in the United Kingdom, European Economic Area, or another jurisdiction that provides data protection rights, you may have rights in relation to the Personal Information we hold about you. Depending upon applicable law, these may include the right to request access to your Personal Information and to ask that it be corrected, updated, restricted, transferred, or deleted.

You may also have the right to object to certain processing of your Personal Information.

You have the right to object at any time to the use of your Personal Information for direct marketing. If you object, we will stop using your Personal Information for that purpose.

Vox Lumiere is based in the United States, and some of the companies and service providers we use may also be located or process information outside the country in which you live.

As a result, your Personal Information may be transferred to and processed in the United States and other countries whose data protection laws may differ from those in your country.

Where UK, European, or other applicable data protection laws require safeguards for an international transfer of Personal Information, we take appropriate steps to ensure that a lawful transfer mechanism or other required safeguard is in place.

DATA RETENTION

We retain Personal Information only for as long as reasonably necessary for the purposes for which it was collected, including fulfilling transactions, administering competitions and promotions, maintaining appropriate business and financial records, meeting legal and regulatory obligations, resolving disputes, and enforcing our agreements.

Where we rely upon consent for marketing, we may retain records of when, where, and how that consent was provided for as long as reasonably necessary to demonstrate that consent was valid.

If you unsubscribe, withdraw consent, or object to direct marketing, we may retain limited Personal Information on a suppression or “do not contact” list so that we can respect your request in the future.

Information collected solely for a competition, prize draw, promotion, or similar activity will not be retained longer than reasonably necessary for that activity and any associated legal, accounting, or administrative requirements, unless you have separately agreed that we may use the information for another purpose.

CHANGES

We may update this Privacy Policy from time to time to reflect changes to our practices, technologies, services, legal requirements, or other operational or regulatory reasons. When we make material changes, we will update the effective date of this Privacy Policy.
